How Division 293 tax is worked out

Two figures are compared. The first is your low-tax concessional contributions. The second is how far Division 293 income plus those contributions sits above $250,000. The15% rate applies only to the smaller of those two amounts. If the combined figure is at or below the threshold, or you have no low-tax contributions, the extra tax is zero.

Division 293 income is not the same as taxable income on its own. Reportable fringe benefits and net investment losses are added back. Reportable super is left out of that income total and brought in as the contribution side of the test. That is why a salary just under$250,000 can still be assessed once employer Super Guarantee is counted.

Employer Super Guarantee for the year can be estimated on theSuper Guarantee calculator. Taxable income can be built first on theincome tax calculator. After-tax contributions that may attract a government match belong on thesuper co-contribution calculator— those amounts are not concessional and do not enter this test.

Official ATO worked example (Jan)

The ATO publishes this example on its Division 293 page. Division 293 income is $240,000 and Division 293 super contributions are $15,000. The combined amount is$255,000. The taxable contributions are the lesser of$15,000 and the $5,000 above the threshold. Tax is 15% of $5,000, which is $750.

Announced measures that are not in this calculator

As at 2026-11-01, the ATO still publishes the$250,000 threshold and the15% rate. No announced change to those Division 293 settings has been enacted, and none is treated as law on this page. Sources:ATO Division 293 threshold tableandATO Division 293 explanation.

A separate tax, Division 296, applies from 1 July 2026 to a share of super earnings once a total super balance is above the large-balance thresholds. That measure is now legislated (ATO Division 296 page, Treasury Laws Amendment (Building a Stronger and Fairer Super System) Act 2026). It is not an adjustment to Division 293 and is not calculated here.

Frequently Asked Questions

What is Division 293 tax?

Division 293 is an extra tax on concessional super contributions. It applies when your Division 293 income plus those low-tax contributions is more than $250,000. The rate is 15%. It sits on top of the usual 15% contributions tax inside the fund. The ATO issues a separate assessment after it has your tax return and the contribution reports from your funds.

How is Division 293 tax calculated?

Add Division 293 income to your low-tax concessional contributions. If that total is over $250,000, the taxable amount is the smaller of those contributions and the dollars above the threshold. Multiply that smaller figure by 15%. The ATO’s published Jan example is income $240,000 plus contributions $15,000. The excess is $5,000, so the tax is $750.

What counts as Division 293 income?

The ATO uses the same starting list as income for the Medicare levy surcharge, but it leaves out reportable super contributions. Those contributions are added later as the low-tax amount. The listed items are taxable income, reportable fringe benefits, net financial investment loss, net rental property loss, and any family-trust distribution tax. An assessable first home super saver release and certain super lump sums taxed at a zero rate are taken off because they already sit in taxable income.

Which contributions are low-tax contributions?

Employer Super Guarantee, salary-sacrifice amounts, and personal contributions you deduct are the usual items. Defined-benefit notional amounts reported by a fund also count. Excess concessional contributions are left out because they are already taxed under the excess-concessional rules. If you use unused concessional cap from earlier years, the extra amount that still fits inside the higher cap is counted.

Did the $250,000 threshold change for 2026-27?

No. The ATO table still shows $250,000 from 2017–18 onwards, including 2026-27. The threshold is not indexed each year. As at 2026-11-01 there is no Bill before Parliament to change that figure or the 15% rate. This page therefore uses only the enacted settings.

Is Division 293 the same as Division 296?

No. Division 296 is a different tax on a share of super earnings once a total super balance is above the large-balance thresholds (from 1 July 2026). It is now law under the Treasury Laws Amendment (Building a Stronger and Fairer Super System) Act 2026. This calculator does not estimate Division 296. Division 293 is only about concessional contributions and the $250,000 combined-income test.

How do I pay a Division 293 assessment?

The ATO can take payment from your own money or, for accumulation accounts, from a release of super if you elect. Defined-benefit amounts are usually deferred in an ATO debt account until an end benefit is paid; interest can accrue on an unpaid deferred balance. Due dates and release forms are on the ATO Division 293 pages.
