Notes
NSW frequency and notice rules
Rent cannot rise in the first 12 months of an agreement. After an increase, the landlord must wait at least another 12 months. If the current rent started on 15 March 2026, the earliest next increase date is 15 March 2027. Written notice for that date would need to be given by 14 January 2027 (60 days earlier).
There is no published percentage cap. A tenant who thinks the new rent is excessive can apply to the NSW Civil and Administrative Tribunal. This calculator only measures the size of the change and the published timing rules.
What the notice must say
The notice must state the proposed new rent, the date it is payable, and be signed, dated and properly addressed. A notice that only says “rent will rise by $30” does not meet the published requirement to state the new amount.
Frequently Asked Questions
How often can rent be increased in NSW?
NSW Fair Trading says rent cannot be increased in the first 12 months of an agreement, and then not more than once in any 12-month period. That limit applies to fixed-term and periodic agreements. A renewal that keeps the same landlord and at least one of the same tenants is still treated as the same rental for this purpose.
How much notice is required in NSW?
The landlord or agent must give at least 60 days written notice. The notice must state the new rent (not only the increase), the day it becomes payable, and be signed, dated and addressed to the tenant. Email can be a written notice.
Do older fixed-term leases follow a different rule?
Some agreements that started before 13 December 2024, for a fixed term shorter than 2 years, can allow more than one increase in 12 months if the increase amount or exact method is written into the agreement. Once that term ends, the 12-month rule applies to the next agreement.
How do I read the earliest next increase date?
Enter the day the current rent started. The calculator adds 12 months. To take effect on that day, written notice would need to be given at least 60 days earlier. Giving notice later pushes the start of the new rent out as well.
Is this legal advice?
No. This page applies published NSW Fair Trading timing rules to the rent and date you enter. It is general information only, not legal advice, and not a finding that a particular notice is valid. You can also check the NSW rental bond calculator if the weekly rent is changing.
